2. Purpose, Information, and Limitation of Liability

The information provided across the Site is for illustrative, educational, and informational purposes only and in no way constitutes professional, medical, nutritional, or veterinary advice.

⚠️ CRITICAL NOTICE REGARDING HEALTH AND BEHAVIOUR

The information, texts, articles, imagery, videos, and recommendations published on this Site—including those concerning health, nutrition, training, or animal behaviour—do not substitute the professional opinion, diagnosis, or treatment of a qualified veterinarian, canine instructor, or other certified professionals.

No information published herein shall be interpreted as a medical prescription, therapeutic plan, or personalised dietary indication.

The application of training techniques or behavioural management described is undertaken at the User's sole risk. The User must always consult their trusted veterinarian before commencing, modifying, or terminating any treatment, diet, or health regime for their animal.

While the Proprietor endeavours to provide accurate and updated information based on the finest available literature and professional experience, we do not guarantee the total absence of errors, omissions, or inaccuracies. Information remains subject to revision, updates, or modification without prior notice.

The use of contents published on the Site is undertaken under the full and exclusive responsibility of the User.

Limitation of Liability

To the maximum extent permitted by applicable law, the Proprietor, their collaborators, and partners shall not be held liable for any direct or indirect damages, whether pecuniary or non-pecuniary, including but not limited to:

  • physical injury to persons or animals resulting from the incorrect or improper application of training or management advice;

  • any failures by third-party providers, external services, or linked platforms.

The Proprietor's liability remains firm exclusively in cases of wilful misconduct or gross negligence, pursuant to Art. 1229 of the Italian Civil Code.

3. Nature of Services and Conditions of Sale

It is expressly noted that the Site does not operate as an e-commerce platform and does not facilitate the direct conclusion of online purchases.

3.1. Status of Commercial Information (Invitation to Treat)

All information regarding puppies, services, courses, or products displayed on the Site—including references to pricing, availability, or genealogical characteristics—is purely informational and promotional in nature. Such information does not constitute a "public offer" under Art. 1336 of the Civil Code, but rather a mere "invitation to treat" or negotiate.

No contract for sale or service provision is deemed concluded simply by navigating the Site or submitting a contact request.

3.2. Finalisation of Sales

The sale of puppies, products, or the provision of professional services is finalised exclusively through direct contact (via telephone, electronic means, or in person) between the User and the Proprietor, followed by the signing of a specific Contract of Sale or Provision. This specific contract shall exclusively govern all aspects of the transaction (final price, health guarantees, delivery methods, and right of withdrawal where applicable). In the event of any discrepancy between the information on the Site and the final contract, the terms of the signed contract shall prevail.

We remind you that, in accordance with the Consumer Code, the legal guarantee of conformity for goods applies to products and animals sold by the Proprietor to Consumer Users.

3.3. Representativeness of Imagery (Living Beings)

The User acknowledges that photographs of animals on the Site are for indicative purposes. As living beings, morphological characteristics (e.g., coat colour, size) and temperament may vary as the subject grows and evolves. No claims may be made based solely on the comparison between the actual subject and the illustrative imagery present on the Site.

4. Intellectual Property

All content present on the Site—including texts, images, photographs, logos, graphics, videos, layouts, software, and source codes—is the exclusive property of the Proprietor or utilised under licence from third parties.

Such contents are protected by Italian and European regulations concerning copyright and trademarks (Law 633/1941, Industrial Property Code, EU Reg. 2017/1001).

Any reproduction, distribution, public communication, modification, or commercial use not expressly authorised in writing by the Proprietor is strictly prohibited.

For specific credits or usage licences, please refer to the Copyright Information page.

5. User Obligations

The User agrees to utilise the Site in full compliance with the law, morality, public order, and these Terms and Conditions. In particular, the User agrees not to:

  • use the Site for illegal, fraudulent, or harmful purposes against third parties;
  • disseminate defamatory, offensive, discriminatory, or obscene content, or content inciting hatred;
  • introduce viruses, malware, bots, or other harmful codes designed to compromise Site functionality;
  • attempt unauthorised access to servers, restricted areas, or linked computer systems (hacking);
  • alter, copy, or interfere with the security or authentication features of the Site.

The Proprietor reserves the right to suspend or block access for Users who violate these obligations, without prejudice to any legal action for the protection of their rights.

6. Access, Interruption, and Maintenance

The Proprietor may modify, suspend, or interrupt access to the Site, in whole or in part, for technical, security, update, or extraordinary maintenance reasons. Where possible, prior notice will be provided via a communication published on the Site.

No guarantee is provided that the Site will be free from interruptions, errors, or defects, nor that any malfunctions will be corrected promptly. The Proprietor shall not be held liable for damages or inconveniences resulting from the unavailability, even temporary, of the Site or its services.

7. Third-Party Links and Services

The Site may contain hypertext links (links) to websites or web resources managed by third parties. These links are provided solely for the User's convenience and further insight.

The Proprietor does not monitor, endorse, or guarantee the contents of such sites and is not responsible for their quality, legality, security, or privacy practices. Access to and navigation of third-party sites are undertaken under the full and exclusive responsibility of the User.

8. Personal Data Protection

The processing of Users' personal data is governed by the Privacy and Cookie Policy, drafted in accordance with Regulation (EU) 2016/679 (GDPR). The User is invited to read said document carefully to understand the methods of collection, processing, and protection of their data.

9. Amendments to Terms

The Proprietor reserves the right to modify these Terms and Conditions at any time to adapt to legislative changes or technical requirements. Amendments shall be effective from the date of publication on the Site, indicated at the top of the document as "Last updated".

Continued use of the Site following the publication of amendments implies their tacit acceptance.

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and interpreted in accordance with Italian Law.

For any dispute arising from the interpretation, validity, or execution of these Terms:

  • Should the User act as a Professional, exclusive territorial jurisdiction is assigned to the Court of Rome.
  • Should the User act as a Consumer, mandatory territorial jurisdiction lies with the judge of the Consumer's place of residence or elective domicile, if located within the territory of the Italian State.

Online Dispute Resolution (ODR)

A Consumer User residing within the European Union has the right to utilise the ODR (Online Dispute Resolution) platform established by the European Commission for out-of-court dispute resolution:
https://ec.europa.eu/consumers/odr/

11. Force Majeure Clause

The Proprietor shall not be liable for any failure or delay in fulfilling their obligations if such failure is caused by events of force majeure or unforeseeable circumstances beyond their reasonable control, such as—by way of example—natural disasters, wars, riots, national network failures, massive cyber-attacks, power supply interruptions, or restrictive measures by competent authorities.

12. Official Language

These Terms and Conditions are drafted in the Italian language. Any translations into other languages are provided solely as a courtesy. In the event of interpretive discrepancies between versions, the Italian language version shall prevail.
